In 3F v Commission, the Court highlighted that the “Community has not only an economic but also a social purpose, the rights under the provisions of the Treaty on State Aid and competition must be balanced, where appropriate, against the objectives pursued by social policy” (§ 58). In other words, sustainable development considerations should be taken into account, and there is no reason not to.
