A complaint registered by Unión General de Trabajadores (UGT) relating to Article 4§2 (the right to a fair remuneration) and Article E (non-discrimination) of the revised European Social Charter has been declared admissible.

UGT alleges that the Spanish legislation on remuneration for overtime work in Spain violates Article 4§2 of the Charter insofar as neither the regulations nor practice guarantee, as a general rule, an increased rate of remuneration for overtime work. UGT further alleges that the non-payment of overtime affects women in particular, in breach of Article E in conjunction with Article 4§2 of the Charter.

A decision on admissibility can be expected in the coming months.
