Interview - Why the EU Adequate Minimum Wage Directive is legally valid: the AG's Opinion (Case C-19/23) critically reviewed" - in Dutch in the Journal Arbeidsrecht
On January 14, 2025, Advocate General Nicholas Emiliou delivered his non-binding opinion to the Court of Justice on the question of whether EU Directive 2022/2041 on adequate minimum wages should be annulled (in whole or in part). The AG's conclusion is, to say the least, controversial. The annulment of the directive would also be unique in labor law. Arbeidsrecht Journaal spoke to Stefan Clauwaert, Senior Legal Advisor and Human Rights at the ETUC, and Piet Van den Bergh, Labor Law Advisor at the ACV Research Department and voluntary employee at the Institute of Labor Law (KU Leuven), about this conclusion. They represent the counter-opinion of the European Trade Union Confederation (ETUC) and analyze the most important legal arguments for us, based on information produced by the ETUC.
