Competition - cooperation agreements 

In cases such as Metro and Remia, the CJEU has furthermore taken into account social aspects in its appreciation of the criteria under Article 101(3) TFEU. In Metro, the Court found “that the requirements for the maintenance of workable competition may be reconciled with the safeguarding of objectives of a different nature and to this end certain restrictions of competition are permissible, provided they are essential to the attainment of those objectives and do not result in the elimination of competition for a substantial part of the common market” (§ 21).
